Contributes to the overall success of the Legal Department in Canada ensuring specific individual goals, plans, initiatives are executed / delivered in support of the team’s business strategies and objectives. Ensures all activities conducted are in compliance with governing regulations, internal policies, and procedures.


Accountabilities:


Role Specific:


  • Provides legal support and guidance to Scotiabank and Tangerine retail banking lines of business operating in Quebec, including real estate secured lending, credit cards and unsecured lines of credit, auto finance, private banking, and retail deposits and investments.
  • Engages with above business lines in Quebec to review documentation, tools, special projects to provide advice and counsel on applicable Canadian and Quebec laws and regulations.
  • Provides subject matter expertise support on Quebec regulatory matters to lawyers on the retail banking legal team.
  • Provides practical, business-focused legal advice and support on Quebec statutory and regulatory issues that impact retail financial products and services including drafting, reviewing, and revising a wide variety of customer-facing documents and materials including retail banking agreements, terms and conditions, marketing, advertisements, press releases, and articles relating to retail banking in Quebec.
  • In conjunction with the Senior Counsel for Quebec, monitors emerging regulatory issues and trends impacting Quebec retail banking, including upcoming legislative changes.
  • Reviews and proactively advises on new, proposed and amended legislation, regulatory guidance and industry best practices affecting the retail banking business In Quebec and recommends changes to policies, processes, controls, and documents.
  • Works closely with Global Compliance regarding regulatory compliance issues including analyzing and interpreting applicable Quebec laws and regulations impacting retails banking including assisting and providing advice on reports submitted to regulators such as the FCAC.
  • In conjunction with the Senior Counsel for Quebec, provides support to other customer-facing departments that handle customer complaints and inquiries such as Ask Operations, Office of the President, Ombudsman’s Office, Corporate Security, and Corporate Communications on matters relating to retail banking matters in Quebec.


General:


  • May participate as Scotiabank’s legal representative on select external industry associations and manages external counsel.
  • Works collaboratively within the Legal Department (both at head office and in Quebec) and with multiple stakeholders including Global Compliance, Corporate Security, Human Resources, Marketing, GRM, and Operational Risk.
  • Champions a customer focused culture to deepen client relationships and leverage broader Bank relationships, systems and knowledge.
  • Understands how the Bank’s risk appetite and risk culture should be considered in day-to-day activities and decisions
  • Actively pursues effective and efficient operations of his/her respective areas in accordance with Scotiabank’s Values, its Code of Conduct and the Global Sales Principles, while ensuring the adequacy, adherence to and effectiveness of day-to-day business controls to meet obligations with respect to operational, compliance, AML/ATF/sanctions and conduct risk.

Education and Experience:


  • Graduate of a recognized law school with 8-10+ years of practical in-house or private practice experience in Quebec.
  • Member in good standing of the Quebec Bar.
  • Able to effectively and successfully manage legal assignments cover a broad range of Bank related matters or specialized areas of law.
  • Strong research skills, including the ability to analyze highly complex legal issues, with little or no precedent.
  • Strong analytical and communications skills, and a thorough knowledge of areas of Quebec law applicable to retail banking lines of business
  • Able to work independently and excellent problem-solving skills.
  • Highly proficient and able to provide legal services in both French and English
